Welcome to Atlas Supplies ("Atlas," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, products, services, content, and tools available through https://atlassupplies.com (the "Service").

By accessing the Site, creating an account, or placing an order, you agree to these Terms and any policies referenced herein, including our Privacy Policy and Return Policy. If you do not agree to these Terms, please do not use the Service.

Our online store is powered by Shopify Inc., which provides the e-commerce platform that enables us to offer our products and services.

1. Eligibility & Acceptable Use

You must be at least the age of majority in your jurisdiction to use the Service.

You agree not to:

• Use the Service for any unlawful purpose.
• Introduce malware, viruses, or other harmful code.
• Attempt to gain unauthorized access to the Site or related systems.
• Interfere with the operation or security of the Service.

Atlas reserves the right to suspend or terminate access to the Service if these Terms are violated.

2. Right to Refuse Service

We reserve the right to refuse service, cancel orders, limit quantities, restrict access, or terminate accounts at our sole discretion, including for suspected fraud, reseller activity, misuse of the Service, inventory limitations, or legal and operational concerns.

3. Site Content & Accuracy

We strive to provide accurate product information, pricing, availability, images, and descriptions. However, errors, inaccuracies, or omissions may occur.

Atlas reserves the right to correct any errors, update information, modify pricing, or cancel orders affected by inaccuracies at any time, including after an order has been submitted.

Historical or archived information appearing on the Site is provided for reference purposes only.

4. Products, Availability & Pricing

Products are offered subject to availability.

We reserve the right to:

• Limit quantities purchased by any customer, household, or business.
• Discontinue products at any time.
• Modify pricing, promotions, and product offerings without notice.

All prices are subject to change without notice.

While we make reasonable efforts to accurately display product images and colors, actual appearance may vary depending on your device settings.

5. Orders, Billing & Payment

By placing an order, you agree to provide current, complete, and accurate billing, shipping, and account information.

Payment is due at the time of purchase unless a commercial credit account has been established and approved by Atlas.

Sales tax will be charged where required by applicable law. Customers claiming a sales tax exemption must provide a valid state-issued resale or exemption certificate before an order can be processed as tax-exempt.

Atlas may contact you using the phone number or email address you provide regarding orders, shipping, customer service matters, or account administration.

6. Commercial Credit Accounts

Businesses seeking open-account purchasing privileges must provide:

• One (1) bank reference; and
• Three (3) trade references.

Until credit information has been received and approved, all purchases must be prepaid or paid by accepted credit card.

Atlas reserves the right to approve, deny, modify, suspend, or revoke credit privileges at its sole discretion.

Any check returned for insufficient funds (NSF) may be subject to a $25.00 service charge, in addition to any fees permitted by law.

7. Shipping & Delivery

Orders are processed Monday through Friday, excluding holidays.

Current order cut-off times are:

• Domestic Orders: 11:00 PM Central Time
• Domestic Next Day Air Orders: 12:00 PM Central Time
• International Orders: 11:00 AM Central Time (shipment next business day)

Processing and delivery times are estimates only and are not guaranteed.

Atlas primarily ships through UPS and USPS. Any special shipping arrangements must be approved in advance. Customers may contact us at (800) 283-7845 to discuss special shipping requirements.

UPS Standard Ground shipping is available for qualifying shipments to Canada.

Customers are responsible for all shipping charges, including shipping charges associated with backordered items that ship separately.

All shipments are F.O.B. Origin, Wheeling, Illinois. Title and risk of loss transfer to the customer upon delivery of the shipment to the carrier.

8. International Orders

Customers placing orders outside the United States are responsible for all import duties, taxes, VAT/GST, brokerage fees, customs clearance fees, and similar charges imposed by their country or carrier unless otherwise stated.

International delivery times are estimates only and may be affected by customs processing, local carrier delays, or other circumstances beyond our control.

9. Returns, Exchanges & Refunds

Returns require prior authorization from Atlas.

Before returning merchandise, customers must obtain a Return Authorization (RA) number. The RA number must be clearly displayed on the outside of the return package.

Unless otherwise specified:

• Standard merchandise may be returned within thirty (30) days of purchase.
• Shaft blanks may be returned within fifteen (15) days of purchase.

Returned items must be unused, undamaged, and in resalable condition.

Returns received after the applicable return period may be accepted at Atlas's sole discretion and may be subject to a restocking fee of up to fifteen percent (15%) of the purchase price.

Shipping charges are non-refundable unless the return results from an error by Atlas.

Atlas reserves the right to refuse any return that does not comply with these requirements.

10. Third-Party Services & Links

The Site may contain links to third-party websites, software, payment processors, shipping carriers, or other services.

Atlas does not control and is not responsible for the content, policies, or practices of third parties. Your use of third-party services is at your own risk and subject to their terms.

11. User Submissions

If you submit reviews, comments, suggestions, photos, or other content ("Submissions"), you grant Atlas a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, and display such content for business purposes.

You agree that your Submissions will not be unlawful, defamatory, abusive, fraudulent, or infringe upon the rights of others.

12. Privacy

Your use of the Service and any personal information you provide are governed by our Privacy Policy.

13. Prohibited Activities

You agree not to:

• Violate any applicable law or regulation.
• Infringe intellectual property rights.
• Harass, threaten, or abuse others.

To the fullest extent permitted by law, Atlas shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the use of the Service or products purchased through the Site.

Where limitations of liability are restricted by law, liability shall be limited to the maximum extent permitted.

You agree to indemnify and hold harmless Atlas, its affiliates, officers, directors, employees, contractors, and service providers from claims, damages, liabilities, losses, and expenses arising from your violation of these Terms or misuse of the Service.

17. Termination

Atlas may suspend or terminate access to the Service at any time if these Terms are violated.

Any provisions intended to survive termination, including disclaimers, limitations of liability, and indemnification obligations, shall remain in effect.

18. Governing Law & Venue

These Terms and any dispute arising out of or relating to the Service, products, or these Terms shall be governed by the laws of the State of Illinois, without regard to conflict-of-law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Lake County, Illinois, and you consent to the jurisdiction of such courts.

19. Changes to These Terms

Atlas reserves the right to modify these Terms at any time by posting updated Terms on the Site.

Changes become effective upon posting. Your continued use of the Service after revised Terms are posted constitutes acceptance of those changes.
